If We Hear It Enough Times It Must Be True

In this age of The White House ‘post truths and alternative facts’ it feels like permission to exaggerate, or simply looking at things in another way is becoming the norm. As Music Supervisors we hear so many ‘alternative facts’ about music licensing that we couldn’t resist putting together 7 alternative facts you may hear:

1. You don’t have to speak to the rights owners – I know the artist’s manager/sister…

2. The record company promoted this track to us, so they will have cleared everything.

3. Any song is available for licensing for any brand – it’s just a matter of how much!!

4. The old rules about synch licensing for music don’t apply to online.

5. This track will be great for this brand – it has over 5 million hits on YouTube

6. Once you have paid for a license, you can re-record the song however you like.

7. You won’t need a synch license for this usage, you are only humming

For the record – “Alternative facts” is the phrase used by Kellyanne Conway, Counselor to the President during a Meet the Press interview on January 22 2017. In an interview with Chuck Todd she tried to explain why Sean Spicer, The President’s Press secretary “utter[ed] a provable falsehood”.  Conway replied “Don’t be so overly dramatic about it, Chuck. You’re saying it’s a falsehood, and … our press secretary, simply gave alternative facts”. Todd quite rightly responded by saying “Alternative facts are not facts. They are falsehoods."
